1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the MineKai website, Minecraft server, online store, and related services (collectively, the “Services”).

MineKai is operated by Eternity Group OÜ, a company registered in Estonia (“MineKai”, “we”, “us”, or “our”).

By accessing the Services, creating an account, joining the MineKai Minecraft server, or making a purchase, you agree to these Terms.

If you do not agree with these Terms, you should not use the Services.

3. MineKai

MineKai is an independent multiplayer Minecraft server and online community.

MineKai is not affiliated with, endorsed by, sponsored by, or associated with Mojang Studios or Microsoft.

Minecraft is a trademark of Microsoft Corporation.

4. Accounts

Certain features of the Services may require a MineKai account and/or Minecraft account.

You are responsible for maintaining the security of your account and for activities performed through your account.

You must provide accurate information where required for purchases or account management.

You may not sell, transfer, share, or otherwise misuse your MineKai account where doing so violates MineKai rules or applicable law.

5. Digital Products

The MineKai Store may offer digital products and benefits, including but not limited to:

• virtual currencies such as Coins or Crowns;
• ranks;
• cosmetic items;
• cosmetic sets;
• crates or similar virtual items;
• account features;
• temporary or permanent digital benefits;
• subscriptions;
• other in-game digital content.

Unless explicitly stated otherwise, these products are digital content or digital services only and no physical product will be delivered.

Digital items have no cash value outside the MineKai Services and cannot be exchanged for real-world money through MineKai.

6. Prices and Payments

Prices are displayed in the currency shown during checkout.

Where required by applicable law, applicable taxes are included in or added to the price and will be shown before payment.

Payments may be processed by third-party payment providers, including Stripe and PayPal.

Your use of a third-party payment provider may also be subject to that provider's terms and privacy practices.

You confirm that you are authorised to use the payment method submitted for a purchase.

7. Delivery

Digital products are normally delivered automatically to the MineKai account or Minecraft account associated with the purchase.

Delivery may occasionally be delayed because of maintenance, technical problems, payment verification, or circumstances outside our reasonable control.

If you have been charged but have not received your purchase, please contact MineKai support rather than purchasing the same product repeatedly.

8. Right of Withdrawal for Digital Content

Consumers may have statutory withdrawal rights under applicable consumer protection law.

Where you purchase digital content that is supplied immediately, we may ask you to expressly consent to delivery beginning before the expiry of the statutory withdrawal period and to acknowledge that you may thereby lose your statutory right of withdrawal once performance has begun, as provided by applicable law.

Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded or restricted.

9. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

Purchases of correctly delivered digital content are generally final once delivery or use has begun, to the extent permitted by applicable law.

This does not affect rights you may have where digital content is defective, incorrectly delivered, not delivered, or where a refund is otherwise required by law.

10. Chargebacks and Payment Disputes

If you believe a payment was made incorrectly or without your authorisation, please contact MineKai support first so that we can investigate the transaction.

Fraudulent chargebacks, knowingly false payment disputes, payment fraud, or attempts to obtain both the purchased digital content and the payment amount may result in suspension of the associated MineKai account where permitted by applicable law.

Nothing in this section prevents you from exercising legitimate rights available through your bank, payment provider, or applicable consumer law.

11. Server Rules and Enforcement

Use of the MineKai Minecraft server is also subject to the applicable server and community rules.

We may issue warnings, restrict features, temporarily suspend accounts, or permanently ban accounts for violations of our rules or these Terms.

A suspension or ban resulting from a user's violation of the applicable rules does not automatically entitle the user to a refund for previously delivered digital content, except where required by applicable law.

12. Availability and Changes

MineKai is an evolving online service.

We may update, modify, rebalance, replace, or discontinue features, game mechanics, content, or Services where reasonably necessary, including for technical, security, gameplay, legal, or operational reasons.

We do not guarantee uninterrupted or error-free availability of the Services.

Any changes affecting purchased digital content remain subject to applicable consumer law.

13. Intellectual Property

The MineKai name, website design, original graphics, custom content, documentation, and other original MineKai materials may be protected by intellectual property rights.

Third-party trademarks and intellectual property remain the property of their respective owners.

Purchasing a digital product does not transfer ownership of MineKai intellectual property to you.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Eternity Group OÜ will not be liable for indirect or consequential losses resulting from use of the Services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer protection rights.

15. Changes to These Terms

We may update these Terms from time to time.

The current version and its effective date will be published on this page.

Material changes will apply in accordance with applicable law and will not retroactively remove mandatory rights relating to previous purchases.

16. Governing Law

These Terms are governed by the laws of the Republic of Estonia, without depriving consumers of mandatory protections available to them under applicable consumer law.
